ReportGarden AI Terms of Use

Effective Date: October 1, 2026

These AI Terms of Use ("AI Terms") are a binding agreement between you and ReportGarden, Inc. ("ReportGarden", "we", "us") and govern your access to and use of ReportGarden's AI Features.
By clicking "I agree", or by accessing or using any AI Feature, you agree to be bound by these AI Terms. If you accept these AI Terms on behalf of an organization, you represent that you have the authority to bind that organization, and "you" refers to that organization. If you do not agree to these AI Terms, you must not use AI Features.

1. Relationship to the Agreement

These AI Terms supplement the ReportGarden Terms of Service, Privacy Policy and, where applicable, Data Processing Agreement (together, the "Agreement"), which continue to apply. In the event of a conflict relating to AI Features, these AI Terms prevail over the Terms of Service, and the Data Processing Agreement prevails with respect to personal data.AI Features are optional and are not required to use ReportGarden.

2. Definitions

• "AI Features" means any feature or functionality of ReportGarden that uses artificial intelligence or machine learning, including, without limitation, the AI assistant, MCP + ReportGarden, Magic Scheduler and AI Widget Creator, as and when made available to you, and any similar features we may introduce in the future.
• "Inputs" means questions, prompts, instructions and content submitted to AI Features, and ReportGarden data accessed by AI Features to generate a response.
• "Outputs" means responses, summaries, insights and other content generated by AI Features.
• "AI Providers" means third-party providers of the AI models used to deliver AI Features.
• "MCP Connection" means a connection authorized by you between your ReportGarden account and a third-party AI application using the Model Context Protocol.
• "Connected AI Tool" means a third-party AI application connected through an MCP Connection.

3. Your responsibilities

You agree that:

• You have all rights, consents and permissions required to use Inputs with AI Features, including data relating to your clients.
• You are responsible for all use of AI Features under your account.
• You are solely responsible for all the activities and the legal liabilities thereof performed on our client portal’s white-labelled Services.

4. Use of data

You acknowledge and agree that:

• ReportGarden processes Inputs and Outputs to provide, secure, support and maintain AI Features.
• ReportGarden does not use Inputs, Outputs or report data to train AI models, and we configure our AI Provider integrations so that this data is not used for model training. 
• AI Features access only data within your account that the relevant user is permitted to view.
• ReportGarden retains AI conversation data for up to 30 days for support and security purposes, unless a longer period is required by law. AI Providers may retain Inputs and Outputs for a limited period, solely for abuse and security monitoring, under their own terms.
• Authorized ReportGarden personnel may access AI conversations to investigate issues you report or to provide support.
• Personal data is handled in accordance with the Privacy Policy and, where applicable, the Data Processing Agreement.

5. AI Providers

You acknowledge that AI Features rely on third-party AI Providers, which ReportGarden may add or change at its discretion. ReportGarden requires its AI Providers to commit to protecting your data and not using it to train their models. A list of current AI Providers is available upon request at support@reportgarden.com.

6. Outputs

You acknowledge that Outputs are generated automatically and may be incomplete, inaccurate or out of date, even when based on your own data. Outputs do not constitute professional, financial or legal advice. You are solely responsible for evaluating Outputs and for any use you make of them. ReportGarden reports and dashboards remain the source of record for your data.

7. Ownership

As between you and ReportGarden, you own your Inputs and, to the extent permitted by law, the Outputs generated for you, and you may use Outputs for your business purposes, including sharing them with your clients. Similar Inputs from different customers may result in similar Outputs, and your rights do not extend to Outputs generated for others.

8. Acceptable use

You agree not to:

• Bypass or attempt to bypass safeguards, extract system instructions, or manipulate AI Features to access data you are not authorized to view
• Submit content that is unlawful, harmful or infringes the rights of others
• Submit sensitive personal data, including health, financial account or government identification information
• Use AI Features or Outputs to develop or train a competing AI model or service
• Use Outputs in a manner that misrepresents their source or accuracy

ReportGarden may suspend or restrict your access to AI Features if it reasonably believes these AI Terms have been violated.

9. MCP Connections

By authorizing an MCP Connection, you acknowledge and agree that:

• Data accessible through the MCP Connection will be transmitted to the Connected AI Tool you select, and once transmitted, is governed by that tool's own terms and privacy policy.
• ReportGarden does not control and is not responsible for any Connected AI Tool.
• Unless otherwise stated in the product at the time of connection, MCP Connections provide read-only access, limited to the data the connecting user is permitted to view.
• You are solely responsible for selecting Connected AI Tools that meet your organization's and your clients' data requirements.
• You may request revocation of an MCP Connection at any time by contacting support@reportgarden.com.

10. Availability of AI Features

AI Features may be offered as beta, preview or early access features and may be subject to usage limits. ReportGarden may modify, suspend, limit or discontinue any AI Feature at any time. Your use of AI Features is voluntary, and you may stop using them at any time without affecting the rest of your ReportGarden service.

11. Disclaimers

AI Features and Outputs are provided "as is" and "as available". To the fullest extent permitted by law, ReportGarden disclaims all warranties, express or implied, including any warranty that AI Features will be uninterrupted or error-free, or that Outputs will be accurate, complete or fit for a particular purpose.

12. Limitation of liability

To the fullest extent permitted by law, ReportGarden is not liable for any decisions made or actions taken based on Outputs, or for the acts or omissions of any Connected AI Tool or its provider.

Some AI Features and Connected AI Tools may be able to create, modify or delete content in your ReportGarden account on your behalf, such as reports, dashboards or scheduled deliveries. You are responsible for the permissions you grant to these tools and for monitoring actions taken through them. ReportGarden is not liable for changes made to your account or data through such actions, including those performed by a Connected AI Tool acting on instructions from you or your users.

All limitations of liability in the Terms of Service apply to AI Features.

13. Changes to these AI Terms

ReportGarden may update these AI Terms from time to time. Updated AI Terms will be posted on this page with a revised effective date, and material changes will be notified through the website or the app. Your continued use of AI Features after an update constitutes acceptance of the updated AI Terms.
